Santa Barbara StudioPass LLC (“StudioPass”, “we”, “our”, or  “us”) collects information about you (“you”, “Member”, or "Members") when you use StudioPass (collectively, the “Platform”), and through other interactions and communications you have with us. This Privacy Policy (“Policy”) applies to information collected and used by StudioPass. This Policy applies to persons anywhere in the world who use our Platform.

1.  COLLECTION OF INFORMATION.

We collect information you provide directly to us, such as when you create or modify your account, contact customer support, or otherwise communicate with us. This information may include: name, email, phone number, postal address, payment method, and other information you choose to provide.

2.  INFORMATION WE COLLECT.

When you use our Platform, we collect information about you in the following categories:

a) Usage and Behavior Information. We may collect information about how you, website visitors, and Members interact with our Platform, behaviors expressed, and settings chosen. In some cases we do this through the use of cookies, pixel tags, and similar technologies that create and maintain unique identifiers; and

b) Log in Information. When you interact with our Platform, we collect server logs, which may include information like device IP address, access dates and times, Platform features or pages viewed, Platform crashes and other system activity, type of browser, and the third-party site or service you were using before interacting with our Platform.

3.  USE OF INFORMATION.

We may use the information we collect about you to:

a) Provide, maintain, improve, and protect our Platform. To facilitate payments, send receipts, provide products and services you request (and send related information), develop new features, provide customer support to Members, authenticate Members, and send product updates and administrative messages;

b) Perform internal operations. To prevent fraud and abuse of our Platform; to troubleshoot Platform bugs and operational problems; to conduct data analysis, testing, and research; and to monitor and analyze usage and activity trends;

c) Send or facilitate communications. Such as Platform updates, pricing changes, adding or removing of partner Studios (“Studios”), and other relevant correspondence;

d) Send you communications we think will be of interest to you. Including information about products, services, promotions, news, and events, where permissible and according to local applicable laws; and to process contest, sweepstake, or other promotion entries and fulfill any related awards; and

e) Personalize and improve our Platform. To provide or recommend features, content, social connections, referrals, and advertisements.

4.  SHARING OF INFORMATION.

We may share the information we collect about you:

a) To Persons Working for StudioPass. StudioPass uses certain trusted third parties to help us provide, maintain, improve, protect, and promote our Platform. These third parties will access your information only to perform tasks on our behalf where permissible, according to local applicable law, and in compliance with this Policy;

b) Third Parties. Third parties, like Mindbody, Inc. (“Mindbody”), will use your information to send information regarding your reservations in the Platform to each respective studio’s Mindbody instance. Mindbody will only use your information for this purpose. However, Studios may use your information to check your identity, and to confirm your reservation in the classes listed on the Platform (“Bookable Classes”);

c) Law and Order. We may disclose your information to law enforcement officials, government authorities, or other third parties if we determine that such disclosure is reasonably necessary to (1) comply with the law; (2) protect any person from death or serious bodily injury; (3) prevent fraud or abuse of StudioPass or our Members; (4) resolve any standing credit or debt on your account; or (5) protect StudioPass's property rights;

d) Business Changes. In connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company, your information may be transferred as part of that deal. We will notify you (for instance, via a message to the email address associated with your account) of any such deal and outline your choices in that event;

e) Retention. If you delete your account, (1) there might be some latency in deleting your information from our servers; and (2) we may retain this information if necessary to comply with our legal obligations, resolve disputes, or enforce our agreements;

f) Other. (1) If we otherwise notify you and you consent to the sharing; and (2) In an aggregated and/or anonymized form which cannot reasonably be used to identify you.

5.  CHANGES TO THE POLICY.

We may change this Policy from time to time. If we make significant changes in the way we treat your personal information, or to the Policy, we will provide you notice through the Platform or by some other means, such as email. Your continued use of the Platform after such notice constitutes your consent to the changes. We encourage you to periodically review the Policy for the latest information on our privacy practices.
